| 1. Acceptance of terms: |
Welcome to mqwap.com, website which allows users to create free personal WAP site. By using the MQWAP web site (the “Website”) you agree to be bound by these Terms of Service (this “Agreement”). In addition, if you wish to become a MQWAP Member (“a Member”) and communicate with other Members or Users and make use of the MQWAP service (the “Service”), you must read this agreement and indicate your acceptance of its terms by following the instructions in the Sign Up page, and checking the box labelled “I agree to MQWAP's Terms of service.” This Agreement explains our obligations to you, and your obligations to us in relation to the MQWAP Service. We reserve the right to modify these Terms at any time. Changes to these Terms will be posted in a revised version of these Terms on our web page at mqwap.com. By using the MQWAP Services, you agree to be bound by this Agreement, whether you are a “Visitor” (which means that you simply browse the MQWAP Website) or you are a “Member” (which means that you have registered with MQWAP). The term “User” refers to a Visitor or a Member. You are only authorized to use the MQWAP Services (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to this Agreement. Please read this Agreement carefully and save it. If you do not agree with it, you should leave the MQWAP Website and discontinue use of the MQWAP Services immediately. If you wish to become a Member, communicate with other Members and make use of the MQWAP Services, you must read this Agreement and indicate your acceptance during the Registration process.

MQWAP Mobile including any predecessor or affiliated companies, does not represent or endorse the accuracy or reliability of any of the advertisements (collectively), i.e. links, downloads, distributions or other information accessed directly or indirectly from host advertisements contained on any of its clients Web Sites and/or Wap Generator interface design (Service), nor the quality of any products, information or other materials displayed, purchased or obtained by any consumer, as a result of an advertisement or any other information or offer in connection with the service or products. MQWAP Mobile shall not be responsible for any errors or omissions contained within any 3rd party advertisement contained within any of its clients Web Sites, and reserve the right to make changes and regulate content without notice. | 4. Users Disputes: |
You are solely responsible for your interactions with other MQWAP Mobile Users. MQWAP Mobile reserves the right, but has no obligation, to monitor disputes between you and other Users.

| 5. Indemnity: |
You agree to defend, indemnify and hold MQWAP Mobile harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, arising out of or relating to:
- Your use of the Website/Mobile Website or the Service (including the Posting by you of any Content on the Website/Mobile Website) in violation of this Agreement;
- Any other breach of this Agreement by you; or
- Your violation of any third-party right, including without limitation any right of privacy, publicity rights or Intellectual Property Rights;
- Your violation of any law, rule or regulation of Singapore or any other country;
- Any claim for damages that arise as a result of any of your User Submissions or any information that are submitted via your account; or
- Any other party's access and use of the Service with your unique username, password or other appropriate security code.

| 6. Disputes: |
| MQWAP Mobile maintains this site in Singapore and you agree that these terms of use and any legal action or proceeding relating to this site shall be governed by the laws of Singapore without reference to its choice of law rules. If you attempt to bring any legal proceedings against MQWAP Mobile you specifically acknowledge that MQWAP Mobile is free to choose the jurisdiction of our preference as to where such action against us may be held. As you have agreed by using this site to choose the laws of Singapore to govern any such proceedings, we will probably choose to defend any such action in Singapore and we can make this decision entirely as it suits us, without regard to where in the world you are located, or from where in the world you visited this site. |
